PRIVACY POLICY

1. Introduction

North West Business Chamber Incorporated (NWBC, we, us, our or the Chamber) is an independent, member-based, not-for-profit organisation established to support, connect and advocate for businesses operating throughout the North West region of Sydney.

NWBC recognises the importance of protecting the privacy and personal information of its members, prospective members, business owners, professionals, community organisations, event attendees, volunteers, sponsors, partners, stakeholders and other individuals with whom the Chamber interacts.

This Privacy Policy explains how NWBC collects, holds, uses and discloses personal information and how individuals can access and correct personal information held by the Chamber or make a privacy complaint.

NWBC is committed to managing personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act), including the Australian Privacy Principles (APPs), to the extent those obligations apply to the Chamber.

This Privacy Policy is intended to provide transparency about NWBC's privacy practices and is made available free of charge through the Chamber's website.

2. Who this Privacy Policy applies to

This Privacy Policy applies to personal information collected and held by NWBC in connection with the Chamber's activities, including:

  • membership applications and administration;
  • member communications;
  • networking and business introductions;
  • Chamber meetings and events;
  • seminars, workshops and networking functions;
  • newsletters and electronic communications;
  • member promotions and business listings;
  • sponsorship and partnership arrangements;
  • website and online services;
  • volunteer and committee activities;
  • advocacy and engagement with businesses and government;
  • surveys, consultations and feedback;
  • photography and recording at Chamber events;
  • enquiries and correspondence;
  • administration of the Chamber; and
  • other activities undertaken in accordance with the Chamber's purposes and Constitution.

This Privacy Policy applies to information collected through the NWBC website, online forms, membership systems, event registrations, email communications, social media and other channels used by the Chamber.

3. What is personal information?

"Personal information" has the meaning given to it under the Privacy Act.

Generally, personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is recorded in a material form or not.

The information NWBC collects will depend on the nature of an individual's interaction with the Chamber.

4. Personal information we may collect

Depending on the circumstances, NWBC may collect and hold personal information including:

Contact information

  • full name;
  • preferred name;
  • business name;
  • position or job title;
  • business address;
  • postal address;
  • email address;
  • telephone number;
  • mobile telephone number; and
  • website or social media details.

Membership information

  • membership application details;
  • membership category;
  • membership status;
  • membership commencement and renewal dates;
  • business information;
  • membership communications;
  • event participation;
  • member preferences;
  • records of interactions with NWBC; and
  • information necessary to administer membership benefits.

Event and participation information

  • event registrations;
  • attendance information;
  • dietary or accessibility requirements where voluntarily provided;
  • photographs;
  • video or audio recordings;
  • feedback; and
  • information provided in connection with Chamber events and activities.

Business and professional information

Where voluntarily provided, NWBC may collect information about:

  • a person's business;
  • industry or profession;
  • business services;
  • professional position;
  • areas of expertise;
  • business website;
  • business social media accounts; and
  • other information relevant to networking, business promotion or Chamber activities.

Communication and correspondence information

NWBC may retain:

  • enquiries;
  • emails;
  • correspondence;
  • telephone records where appropriate;
  • feedback;
  • complaints;
  • survey responses; and
  • other communications with the Chamber.

Transaction information

Where necessary to administer membership, events or other Chamber activities, NWBC may collect information relating to payments and transactions.

Where payment is processed by a third-party payment provider, NWBC may not receive or retain complete payment-card information.

5. Sensitive information

Sensitive information is a particular category of personal information that receives additional protection under the Privacy Act.

NWBC does not ordinarily need to collect sensitive information as part of its normal Chamber activities.

Where sensitive information is collected, NWBC will only collect, use or disclose it where permitted or required by law or where an applicable exception under the Privacy Act applies.

For example, an individual may voluntarily provide information concerning accessibility or dietary requirements for an event. Such information will only be used for the purpose for which it was provided or another purpose permitted by law.

NWBC does not seek to collect sensitive information about political opinions, religious beliefs, racial or ethnic origin, health or other sensitive matters unless reasonably necessary for a legitimate Chamber purpose and permitted under applicable privacy laws.

6. How NWBC collects personal information

Where practicable, NWBC will collect personal information directly from the individual concerned.

This may occur when an individual:

  • applies for membership;
  • renews membership;
  • registers for an event;
  • submits an online form;
  • subscribes to a newsletter;
  • contacts NWBC;
  • sends an email;
  • contacts a Committee member or authorised representative;
  • provides a business card;
  • attends a Chamber event;
  • participates in a survey;
  • volunteers for the Chamber;
  • participates in a Chamber program;
  • enters into a sponsorship or partnership arrangement; or
  • otherwise voluntarily provides information to NWBC.

NWBC may also collect personal information from other sources where permitted by law, including:

  • publicly available business information;
  • member referrals;
  • event partners;
  • business organisations;
  • government or regulatory sources;
  • publicly accessible websites;
  • social media platforms; and
  • service providers engaged by NWBC.

Where NWBC collects personal information from a third party, it will take reasonable steps to comply with its obligations under the Privacy Act.

7. Collection of information through the NWBC website

When an individual uses the NWBC website, certain technical information may be collected automatically.

This may include:

  • IP address;
  • browser type;
  • operating system;
  • device information;
  • date and time of access;
  • pages viewed;
  • referring website;
  • general website usage information; and
  • other technical information generated through the use of the website.

This information may be used to:

  • operate the website;
  • maintain website security;
  • identify technical problems;
  • improve website performance;
  • understand how the website is used; and
  • generate aggregated statistical information.

Where this information constitutes personal information, NWBC will handle it in accordance with this Privacy Policy and applicable privacy law.

The NWBC website may use cookies and similar technologies.

Cookies are small data files that may be placed on a user's device when visiting a website.

9. Why NWBC collects personal information

NWBC collects, holds, uses and discloses personal information for purposes including:

  • administering Chamber membership;
  • processing membership applications and renewals;
  • providing membership services and benefits;
  • communicating with members and prospective members;
  • organising and administering events;
  • facilitating networking and business connections;
  • promoting business opportunities;
  • communicating Chamber news and initiatives;
  • providing information relevant to the local business community;
  • promoting member activities and events;
  • administering sponsorships and partnerships;
  • responding to enquiries;
  • conducting surveys and consultations;
  • seeking feedback;
  • managing volunteers;
  • administering Committee activities;
  • maintaining organisational records;
  • maintaining and improving NWBC's website and services;
  • managing complaints;
  • complying with legal and regulatory obligations;
  • protecting the safety, rights and property of NWBC and other individuals; and
  • carrying out other lawful activities consistent with NWBC's purposes and Constitution.

10. Membership administration

Where an individual becomes a member of NWBC, the Chamber may use their personal information to:

  • establish and maintain membership;
  • communicate membership information;
  • provide membership benefits;
  • send notices and information relevant to membership;
  • administer membership fees;
  • invite members to events;
  • facilitate business networking;
  • provide information about Chamber initiatives;
  • promote opportunities relevant to members; and
  • otherwise manage the relationship between NWBC and its members.

Members are responsible for ensuring that information provided to NWBC is accurate and up to date.

11. Member directory and business promotion

NWBC may provide members with opportunities to promote their businesses through:

  • the NWBC website;
  • member directories;
  • newsletters;
  • event materials;
  • social media;
  • business profiles;
  • promotional campaigns; and
  • other Chamber communications.

NWBC will distinguish, where practicable, between information that a member has chosen to make publicly available and personal information held for internal administrative purposes.

Where publication of personal information is optional, NWBC will seek appropriate consent or provide an opportunity to decline publication.

Members should understand that information voluntarily published on a publicly accessible website or social media platform may be accessible to members of the public and may be copied or redistributed by third parties.

12. Promotion of member activities

NWBC may communicate or promote member events, activities, initiatives, services and business information where doing so is consistent with the Chamber's purposes and policies.

The publication, circulation or promotion of a member's event, activity, business or initiative does not necessarily constitute an endorsement by NWBC of:

  • the member;
  • the member's business;
  • a product or service;
  • an event;
  • a political party;
  • a political candidate;
  • a government policy;
  • an advocacy position; or
  • any particular political, commercial or ideological position.

NWBC may establish internal procedures governing the review and approval of material submitted for publication or circulation.

13. Political independence and personal information

NWBC is an independent, member-based organisation and is not affiliated with, endorsed by or formally aligned with any political party.

NWBC may engage with elected representatives, government agencies and other stakeholders irrespective of political affiliation as part of its advocacy and business-community activities.

Personal information will not be used to imply that an individual supports, endorses or is affiliated with a political party, candidate or political position unless that information has been voluntarily provided for that purpose and its use is otherwise lawful.

14. Photographs, video and recordings

NWBC may photograph or record events, meetings and activities for legitimate organisational, promotional, historical and communications purposes.

Images or recordings may appear in:

  • the NWBC website;
  • newsletters;
  • social media;
  • event reports;
  • promotional materials;
  • presentations;
  • annual reports; and
  • other Chamber communications.

Where practicable, NWBC will provide notice that photography or recording may occur.

Individuals who do not wish to be photographed or recorded should notify NWBC or an event representative where reasonably practicable.

NWBC will consider reasonable requests concerning the use of photographs or recordings, subject to applicable law and practical considerations.

Where an individual is the primary subject of a photograph or recording and the circumstances warrant it, NWBC will seek appropriate consent.

15. Direct marketing and Chamber communications

NWBC may communicate with members, prospective members, subscribers and other individuals about:

  • Chamber events;
  • membership;
  • networking opportunities;
  • Chamber initiatives;
  • business opportunities;
  • newsletters;
  • programs;
  • member activities;
  • sponsorship opportunities; and
  • other information relevant to the Chamber's purposes and the business community.

Where direct marketing laws apply, NWBC will comply with those requirements.

NWBC will provide an appropriate and simple means for individuals to opt out of direct marketing communications.

An individual may unsubscribe by:

  • using the unsubscribe facility included in an electronic communication; or
  • contacting NWBC using the details provided in this Privacy Policy.

NWBC will process valid opt-out requests within a reasonable period.

The OAIC confirms that where APP 7 applies, an organisation must provide individuals with a simple means of opting out of direct marketing and comply with valid opt-out requests.

NWBC will not sell personal information to third parties for their own direct marketing purposes.

16. Disclosure of personal information

NWBC may disclose personal information where reasonably necessary for the purposes described in this Privacy Policy and where permitted or required by law.

Depending on the circumstances, NWBC may disclose personal information to:

  • authorised Committee members;
  • authorised volunteers;
  • employees or contractors;
  • membership management providers;
  • website and technology providers;
  • event management providers;
  • payment service providers;
  • email and communications providers;
  • website hosting providers;
  • professional advisers;
  • accountants and auditors;
  • insurers;
  • event venues and suppliers;
  • sponsors and event partners where appropriate;
  • government agencies and regulators where required or authorised;
  • law enforcement agencies where legally permitted or required; and
  • other persons or organisations where an individual has consented or disclosure is otherwise permitted by law.

NWBC does not sell personal information.

17. Third-party service providers

NWBC may engage external service providers to assist with the operation of the Chamber.

These may include providers of:

  • membership management;
  • website hosting;
  • website security;
  • event registration;
  • email communications;
  • payment processing;
  • accounting;
  • cloud storage;
  • document management;
  • information technology;
  • analytics; and
  • other administrative services.

Where third-party providers handle personal information on behalf of NWBC, NWBC will take reasonable steps to ensure that appropriate privacy and security arrangements are in place.

18. WildApricot and membership management

NWBC uses third-party technology and membership-management services to assist with membership administration, event registration, communications and related activities.

Where NWBC uses WildApricot or another third-party membership management platform, personal information may be collected, stored or processed through that platform.

The information collected may include:

  • member names;
  • business details;
  • contact details;
  • membership information;
  • event registrations;
  • payment-related information;
  • communications; and
  • other information required to administer Chamber activities.

NWBC will review the privacy and security arrangements of relevant providers and will update this Privacy Policy where material changes to those arrangements occur.

19. Overseas disclosure of personal information

Some of NWBC's service providers may store or process personal information outside Australia.

Accordingly, personal information may be disclosed to or processed by overseas recipients depending on the technology and service providers used by NWBC from time to time.

Potential overseas locations may include:

  • the United States;
  • New Zealand;
  • Singapore;
  • countries within the European Union; and
  • other countries in which NWBC's service providers operate.

The specific countries may change as NWBC changes or updates its service providers.

Before disclosing personal information overseas, NWBC will take reasonable steps to comply with its obligations under APP 8 and other applicable provisions of the Privacy Act.

Under APP 8, an organisation generally has obligations to take reasonable steps to ensure an overseas recipient does not breach the APPs in relation to the information, subject to applicable exceptions.

Where practicable, NWBC will identify relevant overseas locations through its collection notices or other privacy information.

20. Anonymity and pseudonymity

Where lawful and practicable, individuals may interact with NWBC anonymously or using a pseudonym.

However, this may not be practicable where NWBC needs to:

  • administer membership;
  • process a payment;
  • respond to a specific request;
  • verify a person's identity;
  • comply with a legal obligation;
  • administer an event;
  • provide a particular service; or
  • otherwise properly conduct the relevant Chamber activity.

21. Quality of personal information

NWBC takes reasonable steps to ensure that personal information it collects, holds, uses or discloses is accurate, complete, up to date and relevant for the purpose for which it is used.

Individuals are encouraged to notify NWBC if their personal information changes.

22. Security of personal information

NWBC takes reasonable steps to protect personal information from:

  • misuse;
  • interference;
  • loss;
  • unauthorised access;
  • unauthorised modification; and
  • unauthorised disclosure.

Depending on the circumstances, safeguards may include:

  • restricted access;
  • password protection;
  • user authentication;
  • secure cloud-based systems;
  • access controls;
  • appropriate administrative procedures;
  • secure disposal;
  • confidentiality requirements;
  • contractual requirements for service providers; and
  • other reasonable technical and organisational safeguards.

NWBC does not publish detailed information about its security systems where doing so could compromise their effectiveness.

The OAIC's APP 11 guidance requires organisations to take reasonable steps to protect personal information from misuse, interference and loss and from unauthorised access, modification or disclosure.

23. Data breaches

NWBC takes reasonable steps to prevent, identify and respond to data breaches.

Where NWBC becomes aware of a suspected or actual data breach, it will assess and respond to the incident in accordance with its internal procedures and applicable law.

Where an incident constitutes an eligible data breach under the Privacy Act and notification is legally required, NWBC will comply with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner where required.

24. Retention and destruction of personal information

NWBC will retain personal information only for as long as reasonably necessary for:

  • the purpose for which it was collected;
  • membership administration;
  • legitimate organisational record-keeping;
  • legal or regulatory requirements;
  • resolving disputes;
  • establishing or defending legal claims; or
  • other lawful purposes.

When personal information is no longer required, NWBC will take reasonable steps to securely destroy or de-identify the information, unless it is required or permitted to be retained.

25. Access to personal information

An individual may request access to personal information that NWBC holds about them.

Requests should be made in writing and should include sufficient information to enable NWBC to identify the relevant information.

NWBC may need to verify the identity of the person making the request.

Subject to applicable exceptions under the Privacy Act, NWBC will provide access to personal information in an appropriate form.

Where access is refused, NWBC will provide reasons where required by law.

The OAIC confirms that APP 12 generally requires an APP entity to provide access to personal information it holds about an individual unless an applicable exception applies.

26. Correction of personal information

An individual may request that NWBC correct personal information held about them if the information is inaccurate, out of date, incomplete, irrelevant or misleading.

Requests should be made in writing and should identify the information believed to require correction.

NWBC will consider correction requests and take reasonable steps to correct information where appropriate.

Where required by law, NWBC may also notify relevant third parties of corrections.

27. Privacy complaints

NWBC takes privacy complaints seriously.

If an individual believes that NWBC has mishandled their personal information or breached an Australian Privacy Principle, they should contact NWBC in the first instance.

A privacy complaint should include:

  • the individual's name and contact details;
  • details of the concern;
  • relevant dates;
  • relevant correspondence or supporting information; and
  • the outcome sought, where applicable.

NWBC will:

  1. acknowledge the complaint;
  2. assess the issues raised;
  3. investigate where appropriate;
  4. seek further information if required;
  5. take reasonable steps to address the complaint; and
  6. provide a response within a reasonable period.

NWBC will not charge an individual for making a privacy complaint.

28. Privacy Officer

NWBC will designate an appropriate person within the organisation to oversee privacy matters.

The Privacy Officer may be the Secretary, another Office Bearer, Committee member or another person authorised by the Committee.

29. Complaints to the Office of the Australian Information Commissioner

Individuals are encouraged to first raise the matter with NWBC in order to allow the Chamber to have an opportunity to investigate and resolve the issue. We will respond to the complaint within 30 days. If you are not satisfied with our response to a privacy complaint, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

30. Third-party websites and social media

The NWBC website may contain links to third-party websites, social media platforms and other online services.

Those organisations have their own privacy policies and terms of use.

NWBC is not responsible for the privacy practices, security or content of third-party websites or services.

Individuals should review the privacy policies of third-party services before providing personal information.

31. Social media

NWBC may operate or maintain social media accounts and may publish information, photographs and other content through social media platforms.

When an individual interacts with NWBC through a social media platform, that platform may independently collect and process personal information in accordance with its own privacy policy.

NWBC will handle information received through social media in accordance with this Privacy Policy and applicable law.

32. Children

NWBC's activities are primarily directed towards businesses, business owners, professionals and adult community stakeholders.

NWBC does not generally seek to collect personal information from children.

Where NWBC becomes aware that it has collected personal information from a child in circumstances where the information was not reasonably necessary or authorised, it will consider appropriate steps to delete or de-identify the information, subject to applicable legal obligations.

33. Privacy and member information

Membership of NWBC does not give members an unrestricted right to access personal information concerning other members.

Information about members will only be disclosed to another member where:

  • the information has been made publicly available;
  • the member has consented;
  • disclosure is reasonably necessary for a Chamber activity;
  • disclosure is authorised under the Chamber's Constitution or policies; or
  • disclosure is otherwise permitted or required by law.

34. No sale of personal information

NWBC does not sell, rent or trade personal information to third parties.

NWBC may disclose information to service providers, sponsors, event partners or other organisations where reasonably necessary for Chamber activities and where the disclosure is lawful and consistent with this Privacy Policy.

35. Privacy and governance

NWBC is committed to maintaining appropriate privacy governance arrangements.

The Committee may establish policies, procedures and internal controls concerning:

  • privacy;
  • information security;
  • member information;
  • data retention;
  • access to information;
  • complaints;
  • data breaches;
  • photography and recording;
  • website and technology use; and
  • the use of third-party service providers.

The Committee will periodically review NWBC's privacy practices to ensure that they remain appropriate for the Chamber's activities.

36. Changes to this Privacy Policy

NWBC may amend this Privacy Policy from time to time to reflect:

  • changes to privacy laws;
  • changes to the Australian Privacy Principles;
  • changes to technology;
  • changes to Chamber activities;
  • changes to membership services;
  • changes to third-party service providers; or
  • changes to the way NWBC collects, holds, uses or discloses personal information.

The most recent version will be published on the NWBC website.

NWBC intends to review this Privacy Policy at least annually and whenever there is a material change to its information-handling practices.

37. Automated decision-making

NWBC does not currently intend to use personal information through automated decision-making systems in circumstances where a computer program makes decisions that could reasonably be expected to significantly affect an individual's rights or interests.

If NWBC introduces such a system in the future, it will review its privacy obligations and update this Privacy Policy as required.

From 10 December 2026, additional APP 1 privacy-policy requirements will apply where an APP entity arranges for a computer program to use personal information to make certain decisions that could reasonably be expected to significantly affect an individual's rights or interests.
